Domestic Partnerships

Domestic Partnerships

California Domestic Partnership Lawyers

In 1999, same-sex couples in California became eligible to receive many of the same rights as married couples under the terms of the state's domestic partnership law. Unmarried opposite-sex couples in which one partner is age 62 or older were also given the right to establish domestic partnerships.

Expansion of Rights

Since 2005, registered domestic partners have enjoyed the same rights, protections and benefits, and have been subject to the same responsibilities, obligations and duties under law as married spouses, according to California Family Law. These include community property rights, support rights, and inheritance rights.

Cohabitation alone does not guarantee property rights or "palimony." California does not recognize common law marriages. Domestic partnerships ensure that you and your partner will enjoy the same rights as married couples.

Protecting Your Future

Unless you specifically opt out of community property rights at the time you register your domestic partnership, your assets will be considered community property if and when your relationship is ever legally dissolved.

At the Louder Law Group, our family law attorneys provide a full range of legal services to couples who are living together and want to establish or dissolve a domestic partnership or to modify the terms of a partnership dissolution. When children are involved, issues of adoption, paternity, child custody and visitation, and child support may need to be negotiated or litigated.

Not every cohabitating couple is eligible to register as domestic partners. To learn whether domestic partnership is an option for you, please contact our law firm today to arrange a free consultation.
